CONDITIONS OF SALE
The items listed in this auction, as may be amended by sale room notice or announcement, are being offered for sale by Music and Beyond (the Charity) for its own account. The following terms and conditions of sale constitute the complete terms and conditions on which all of the items will be offered for sale. All purchasers of alcoholic beverages through the auction must be nineteen (19) years of age or older. Proof of age may be required prior to the transfer of any purchased goods, including, but not limited to provision of photo identification.
CONDITION OF THE WINES
Lots are sold “as is” without recourse. The Charity may not give any warranty of any kind as to any of the lots, nor shall they be liable in any manner for any error in description, faults or defects. All warranties and conditions implied by law are hereby excluded. No person shall have recourse against the Charity for any irregularity or illegality in the sale, in the conduct of the sale, or of the lots. The wine offered for sale at the auction may not have been tested by the Liquor Control Board of Ontario. The purchaser of the wine by way of the auction is required by law to acknowledge this in writing.
BIDDING
All bidding will take place on the online auction site. Bidding increments have been set at the discretion of the Charity and must be adhered to. Bids are in Canadian dollars. There are no premiums or taxes on any lot. The highest bidder at the time of the auction closing shall be the purchaser. The Charity has the right to reject any bid and, in the event of any dispute between bidders, to determine the successful bidder or to re-offer and re-sell the item in dispute. Should there be any dispute after the sale, the Charity’s record of final sale shall be conclusive.
PAYMENT
Items purchased at the auction must be paid for online. No delivery will be made until full payment has been received. All items are final sale, unless otherwise stated.
PICKUP AND DELIVERY
The purchaser will be contacted regarding pickup or delivery of their item(s). The purchaser may request delivery, which will be charged to the purchaser. Electronic gift certificates will be emailed to the purchaser upon payment.
RESERVES
All the lots offered are subject to a reserve or Opening Bid.
WINE
I hereby request the Music and Beyond festival, acting through its agents or employees, to honour any bids and order to purchase according to the terms and conditions set forth in the catalogue or publicly announced during the sale. I acknowledge that wines purchased at this auction may not have been tested by the Liquor Control Board of Ontario (LCBO).
